More trouble for Salman Khan

MUMBAI, February 1, 2013





Actor Salman Khan is now facing more trouble — the additional metropolitan magistrate court at Bandra here on Thursday added the harsher Indian Penal Code (IPC) Section of culpable homicide not amounting to murder in the 2002 hit-and-run case against him.



The court has now committed the case to the Sessions Court and asked him to appear before it on March 11. The Sessions Court will again frame charges against him.



At present, he is booked under Section 304-A of the IPC (rash and negligent driving). The maximum punishment under it is two years. After the court's decision on Thursday, he will be framed under Section 304-II of the IPC, which has a maximum punishment of 10 years.



The Bombay High Court had held that Section 304 part II was not applicable in the case and the actor be tried under 304-A and other relevant sections. However, in 2011, the police once again sought Mr. Khan's trial on the more serious charge of 'culpable homicide not amounting to murder."



As per the prosecution, one person was killed and four others sleeping on a pavement in Bandra were injured when Mr. Khan's Toyota Land Cruiser rammed a bakery on the night of September 28, 2002.
