Supreme Court issues notice to Centre on Afzal Guru plea

The Supreme Court on Friday issued notice to the central and Delhi governments on Parliament attack convict Afzal Guru\'s petition seeking transfer to a prison in J&K from Tihar jail.





Jaish-e-Mohammed terrorist Mohd Afzal Guru, awaiting death penalty in Tihar Jail following his conviction for plotting terror attack onParliament in 2001, has moved the Supreme Court on January 2011 for shifting him to a jail in Jammu and Kashmir.Guru was convicted on terror charges by an anti-terrorcourt in December 2002.



The apex court bench of Justices Aftab Alam and R.M. Lodha issued notice after the court inquired if there was any jail other than in Srinagar where the petitioner would like to be shifted.



Appearing for the petitioner, senior counsel V.C. Mahajan told the court that under the rules, a convict should be lodged in a jail at the place of his residence. He told the court that Afzal Guru\'s 90-year old mother, 11-year-old son and his wife have to travel repeatedly from Srinagar to Delhi to meet him.





In his petition, Guru sought his shifting out fromTihar Jail saying his stay in a jail in his native state wouldbe more convenient for his family members, who cannot come allthe way to Delhi every now and then to meet him.



In December 2002, Guru was convicted of waging war against India and was given the death sentence by a trial court in Delhi. A year later, the Delhi High Court confirmed that death sentence. In 2005, the Supreme Court rejected an appeal byGuru. He has filed a mercy petition with the President of India, which has yet to be decided. His appeal was sent by the President to the Home Ministry which forwarded it to the Delhi government, where it is now pending.
